Essential information. Please read the following terms and conditions. Acceptance of these terms is an absolute condition of this website and the services of JM Web Solutions (JMWS).

General Terms and Conditions

These terms and conditions form the trading agreement between JMWS ("we" or "us") and the Client ("you").

Project Commencement & Deposit

A 25% non-refundable deposit is required before any work begins. No design, development, planning, or setup will start until the deposit has been received and all required client content and assets have been supplied.

Cancellation of Services by You

If you wish to cancel any ongoing services, you must give us notice at least 30 days before the Initial Term or any Additional Term ends. If sufficient notice is not given, an Additional Term will automatically apply. Notice may be given verbally to your account manager but must be confirmed in writing by email to support@jmwebsolutions.co.uk.

Liability

To the fullest extent permitted by law, JMWS is not liable for any losses or damages of any kind, including loss of profit, revenue, savings, data, business opportunities, or any indirect or consequential loss or damage. You agree that you will not claim back or seek recovery of any fees paid to JMWS, including deposits, subscriptions, or project payments. All fees are non-refundable unless we agree otherwise in writing.

Licence and Ownership - Websites

Ownership of the website passes to you upon payment in full of the agreed amount and any applicable taxes. If you enter into a hosting agreement with JMWS, this must be completed and paid before ownership is passed and files are provided. Automatic updates are only available to customers with an active hosting subscription.

Content

We do not provide copywriting unless otherwise agreed. It is your responsibility to provide written content for your website or project. We can provide a professional copywriting quote upon request.

Graphics and Photographs

Any graphics, images, photographs, or videos provided by you must be legally licensed and supplied in editable digital form. By sending assets, you confirm you have the required intellectual property rights or licenses. Please supply the highest resolution possible; low-quality images may not be used. We may use stock images on a fair-use basis, typically up to 10 images. More than 10 may incur additional charges.

Service Level

We use reasonable endeavours to make the server and services available at all times, but because services rely on computer and telecommunications systems, JMWS makes no warranties that services will be uninterrupted or error-free. We are not liable for interruptions, downtime, or third-party outages. Where managed hosting is provided, we may retain regular offsite backups of content and databases, but we do not accept responsibility for data loss or corruption.

Domain Name Registration

Domain names are not deemed successfully registered until they appear in the relevant WHOIS database. If a domain is unavailable when we attempt to register it, we will refund the domain fee only. We will make reasonable endeavours to renew domains where the renewal fee has been paid. If a domain cannot be renewed and is subsequently lost, our liability is limited to the renewal fee for that domain.

Search Engine Optimisation (SEO)

We aim to improve visibility, however we do not control search engine decisions, broad algorithm updates, or indexing schedules. We do not guarantee rankings, traffic increases, sales, or any specific outcomes from optimisation services.

Promotional Materials

You agree that JMWS may refer to you by company or trading name and to the existence of this Agreement in marketing or promotional materials. You grant JMWS a royalty-free licence to use your company name, trade name, and logo on our website, social media, and online or offline marketing.

Acceptance of Terms

Payment of a deposit or subscription constitutes full acceptance of these Terms & Conditions.
